General Acceptance

Acceptance of Terms: By accessing or using the services, website, or booking platform (“the Service”) provided by Carolina Furnished Rentals, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“T&Cs”). These T&Cs apply to all guests, users, and all others who access or use the Service. 

If you disagree with any part of the terms, you must not access the Service or proceed with any booking. Your use of the Service constitutes your acceptance of these Terms, creating a legally binding contract between you and Carolina Furnished Rentals.

Definitions. For the purpose of these Terms and Conditions:

• “Company” or “We/Us” refers to Carolina Furnished Rentals, operating under the laws of the State of North Carolina.
• “Service” refers to the reservation, booking, property management, and hospitality services provided by the Company through its platforms.
• “Platform” refers to the Company’s website, mobile applications, and any other proprietary online channels used to offer and facilitate bookings.
• “Guest” or “User” means the individual or entity accessing the Platform or Service, agreeing to these Terms, and/or executing a Rental Agreement.
• “Mid-Term Rental (MTR)” refers to a residential tenancy with a duration typically ranging from thirty (30) days to twelve (12) months.
• “Property” means any furnished residential unit, including all associated amenities and furnishings, managed and made available for rent by the Company.
• “Rental Agreement” means the specific, legally binding contract executed between the Company and the Guest detailing the terms, period, and financial obligations for the rental of a specific Property.

Nature of Services

Service Description. Carolina Furnished Rentals (the “Company”) is a marketing and guest facilitation business that assists homeowners in promoting their fully furnished properties for short- and mid-term stays, primarily ranging from 30 days to 12 months. While one or more members of the Company may hold active real estate licenses in North Carolina, the services provided through Carolina Furnished Rentals are not offered under or through a licensed real estate brokerage. The Company does not engage in property management or brokerage representation and does not collect, hold, or distribute rental payments on behalf of property owners.

Marketing and Guest Coordination. The Company provides property listing, advertising, guest inquiry coordination, and lease facilitation services. Carolina Furnished Rentals may assist in the connection between a guest and the property owner, but all rental agreements are executed directly between the guest and the property owner or their designated representative. Rental payments are also handled directly between those parties or via a third-party booking platform. Carolina Furnished Rentals is not a party to the rental agreement and does not assume any responsibility for the legal or financial terms therein.

Disclaimer of Brokerage Relationship. No brokerage, agency, or fiduciary relationship is established through the use of this website or the services offered by Carolina Furnished Rentals. Any licensed individuals involved with the Company are acting in their personal capacity and not as agents of a real estate brokerage in connection with the services provided here. All users are advised to seek legal, financial, or real estate advice from qualified professionals where appropriate.

User Responsibilities and Conduct

User Obligations. By utilizing the Service and/or executing a Rental Agreement, the Guest/User agrees to the following responsibilities:

• Compliance with Rental Agreement: The Guest must strictly adhere to all terms, conditions, and rules stipulated in the specific Rental Agreement executed for the Property. This agreement governs occupancy period, rent payments, security deposits, and maintenance obligations.
• Compliance with Local Regulations: The Guest must comply with all applicable local, state, and federal laws, including the ordinances and regulations of Raleigh, North Carolina, and Wake County.
• Property Condition: The Guest is responsible for maintaining the Property in a clean and safe condition, utilizing all appliances and systems in a reasonable manner, and notifying the Company immediately of any necessary repairs or damage.
• Community and HOA Rules: If the Property is located within a planned community, condominium, or homeowner’s association (HOA), the Guest must strictly adhere to all rules, regulations, and bylaws of the specific community, which are provided upon lease signing. Violations of these rules may result in fines or eviction.
• Insurance and Risk: The Guest is strongly encouraged to obtain Renter’s Insurance to protect personal belongings and cover liability risks, as the Company’s policy does not cover the User’s personal property.

Prohibited Uses. Users and Guests are strictly prohibited from:

• Using the Property for any illegal or commercial purpose, including short-term rentals (such as Airbnb or Vrbo), without the express written consent of the Company.
• Engaging in excessive noise, disruption, or conduct that violates the peace and quiet enjoyment of neighboring tenants or property owners, particularly during designated quiet hours.
• Making alterations, additions, or improvements to the Property without prior written consent from the Company.
• Any act that compromises the safety or security of the Property, the building, or other residents.

Consequences of Breach. Any failure by the User or Guest to comply with these Responsibilities and Prohibited Uses shall constitute a material breach of these T&Cs and/or the Rental Agreement, which may result in immediate termination of tenancy, financial penalties, and/or expedited eviction, as permitted under North Carolina law.

Intellectual Property and Content Rights

The Platform, and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Carolina Furnished Rentals, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Legal and Liability Provisions

16. Disclaimer of Warranties. The Platform, the Service, and all associated content are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the Service is at your sole risk.
17. Limitation of Liability. To the fullest extent permitted by North Carolina law, in no event shall Carolina Furnished Rentals, nor its directors, employees, agents, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content. This limitation applies regardless of whether the liability is based on warranty, contract, tort (including negligence), or any other legal theory.
18. Indemnification. You agree to defend, indemnify, and hold harmless Carolina Furnished Rentals, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from (i) your use of and access to the Service; (ii) your violation of any term of these T&Cs or the executed Rental Agreement; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive the termination of these T&Cs and your use of the Service.

Jurisdiction and Final Terms

Governing Law. These Terms and Conditions and the relationship between the User/Guest and Carolina Furnished Rentals shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Wake County, North Carolina for the resolution of any disputes.

Arbitration and Dispute Resolution. Any controversy or claim arising out of or relating to these T&Cs or any Rental Agreement shall be settled exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall take place in Raleigh, North Carolina.

Entire Agreement. These Terms and Conditions, along with the specific Rental Agreement executed for a Property, constitute the entire agreement between you and the Company concerning the Service and supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written.

Severability. If any provision of these T&Cs is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these T&Cs shall remain in full force and effect.
